Euro Hi-Tech Photographic Services Terms
and Conditions of Repairs
These conditions
shall apply to any agreement between Euro Hi-Tech Photographic Services
Ltd U.K. Limited ("Euro Hi-Tech Photographic Services Ltd") and any
person, business or company ("The Customer") requesting Euro Hi-Tech
Photographic Services Ltd to repair (“service” ) any goods or parts
thereof ("the Goods"). The expression "Repair" shall include testing and
adjustment. These conditions apply also to goods left with Euro Hi-Tech
Photographic Services Ltd for evaluation or quotation.
1. Estimates
a) Euro Hi-Tech Photographic Services will provide ‘free estimates’ for
all cameras before work is undertaken. We reserve the right to
re-estimate once a proceed has been provided. b) Euro Hi-Tech
Photographic Services Ltd shall be under no obligation to give the
Customer a written estimate before commencing to service the Goods
unless the Customer gives Euro Hi-Tech Photographic Services Ltd a
written request for an estimate. All written estimates are chargeable
and require payment.
c) Where an estimate is given, Euro Hi-Tech Photographic Services Ltd
may delay commencing work until the Customer gives Euro Hi-Tech
Photographic Services Ltd by email or telephone informing us to proceed.
If there is no form of correspondence to carry out the repair within 28
days of the date of the estimate, Euro Hi-Tech Photographic Services Ltd
may return the Goods to the Customer at the Customer's expense.
d) When Euro Hi-Tech Photographic Services Ltd does not service the
camera, Euro Hi-Tech Photographic Services Ltd may charge for the
examination and re-assembly of the goods. Euro Hi-Tech Photographic
Services Ltd shall attempt to re-assemble the Goods to the condition in
which they were received but shall not be liable to the Customer for any
loss or damage whatsoever resulting from its failure so to do.
2. Quality of Repair
a) Unless otherwise agreed Euro Hi-Tech Photographic Services Ltd shall
repair the Goods to the manufacturer's specification, with the use of
calibration software. b) Euro Hi-Tech Photographic Services Ltd shall use it own means to
decide the following:
1) The technique and practice
used to repair
2) The component required for
the repair
3) In the case of goods which
are beyond economical repair, we will directly contact the customer in
which there will be liability in returning the item back.
c) Euro Hi-Tech Photographic Services Ltd may decide to outsource all or
part of the repair work.
d) Standard Repair time takes 5-6 working days which is subject to
delays where part constraints apply.
All camcorder repairs take up to one month.
3. Cancellation
or Delay of Service
Euro Hi-Tech Photographic Services Ltd provides quotes for the repair
completion dates which are approximate only and Euro Hi-Tech
Photographic Services Ltd shall not be liable for any loss whatsoever
resulting from failure to meet such dates. Euro Hi-Tech Photographic
Services Ltd may postpone or cancel repair work at any time.
4. Collection and Delivery of the Goods
Any product returned for repair must be accompanied by a contact name,
address and daytime telephone number, if this information is not
provided, Euro Hi-Tech Photographic Services Ltd will be unable to
return your product to you and reserves the right to dispose of your
product three months after receipts. (Equipment left for repair is
subjected to the conditions of the Disposal of Uncollected Goods Act
1952)
a) Collection of repaired goods can be made from Euro Hi-Tech
Photographic Services Ltd's premises. Euro Hi-Tech Photographic Services
Ltd reserves the right to charge the customer if the Goods are not
collected within 21 days of the date on which Euro Hi-Tech Photographic
Services Ltd notifies the Customer (by post or otherwise) that the Goods
are available for collection.
b) Where Euro Hi-Tech Photographic Services Ltd agrees to dispatch the
Goods, the method of packing and dispatch of the Goods shall be at Euro
Hi-Tech Photographic Services Ltd's discretion.
The Goods shall be
dispatched at the Customer's risk and, except where the Goods are
repaired Warranty, at the Customer's expense. Notification of damage
must be communicated in writing to both Euro Hi-Tech Photographic
Services Ltd and the Carrier within three days of delivery. Notification
of non-delivery must be communicated in writing to both Euro Hi-Tech
Photographic Services Ltd and the Carrier within seven days of the date
of the dispatch note or invoice.
5. Payment
a) Payment of Euro Hi-Tech Photographic Services Ltd's charges shall be
made before the Goods are dispatched from Euro Hi-Tech Photographic
Services Ltd's premises or within 21 days of the date of notification
mentioned in clause 4, whichever is earlier.
b) Customers with approved accounts with Euro Hi-Tech Photographic
Services Ltd shall pay Euro Hi-Tech Photographic Services Ltd's charges
by the end of the calendar month following the month during which the
repair charges are invoiced.
c) Euro Hi-Tech Photographic Services Ltd reserves the right to add
interest at the rate of 3% per month to the outstanding balance of
overdue accounts accruing daily.
d) If the Customer shall fail to pay all sums due for the repair and to
collect the Goods within 6 months of the date of the notification
mentioned in clause 4(a), Euro Hi-Tech Photographic Services Ltd may
forthwith sell the Goods at such price as it in its discretion thinks
fit and may retain from the proceeds of sale an amount sufficient to
clear the costs of repair and storage and expenses incurred in
attempting to trace the Customer and in arranging for the sale of the
Goods. Any deficiency shall forthwith be made up by the Customer and if
Euro Hi-Tech Photographic Services Ltd shall dispatch any excess to the
Customer's last known address it shall be under no further liability
whatsoever. No interest shall be payable on any balance retained by Euro
Hi-Tech Photographic Services Ltd.
All prices quoted includes
VAT, spare parts, labour, service and return carriage. Repairs will only
be undertaken on receipt of payment (by, Cash, Switch, cheque, Visa, or Mastercard)
6. Warranty
Workmanship and materials used by Euro Hi Tech Photographic Services Ltd
in any repair of Digital Products, photographic have warranty for six
(6) months, from the date of repair to be free from defects under normal
use. Our obligation under such repair warranty is limited to repairing
the original defects and subject to the equipment being accompanied by
proof of repair by Euro Hi-Tech Photographic Services Ltd i.e Euro
Hi-Tech Photographic Services Repair Order Number. Together detailed
defect description. The repair warranty is void if any repairs are
undertaken by a different Service Centre, or equipment is misused, neglected, damaged
or if any defects arises from battery leakage and liquid damage.
Euro Hi Tech
Photographic Services Ltd will notify you, indicating the nature of the
defect, whether or not repair is possible and if so an estimate for the
cost of repair.
7.
Formation
These conditions may not be varied except by written agreement signed by
a Director or duly authorised officer of Euro Hi-Tech Photographic
Services Ltd. Any reference to writing in these conditions shall include
electronically recorded or transmitted material. These conditions and
any agreement between Euro Hi-Tech Photographic Services Ltd and the
Customer relating to the repair of the Goods shall be governed by
English Law
8. Service Please note that Euro Hi-Tech Photographic Services Ltd will Endeavour
to ensure the safety of your products whilst in its possession. However,
whilst every effort will be made to return your product (and any film,
tape, or other recordable media or accessory) Euro Hi Tech Photographic
Services Ltd cannot accept any liability, nor pay any compensation for
loss of a particular film or tape or other recordable media included.
Euro Hi Tech Photographic Services Ltd cannot be held responsible for
any damage caused to a product being returned to the Service Centre for
repair other then caused by our own proven negligence. We exclude any
liability for any indirect or consequential loss, damage or expense.
